NCC Calls for Review of MoU on RoW

PRESS RELEASE: NCC calls for review of MoU on RoW accuses State Governors of violating agreement

The Nigerian Com-munications Commission, NCC, has called for a review of the Memorandum of Uunderstanding, MoU between the federal and state governments and telecom operators on Right of Way, RoW,to enable telecom service providers deploy optic fibre cables for broadband penetration plan.

The Executive Vice- Chairman of the Commission, Prof. Umar Danbatta made the call in Abuja in a chat with journalists, after the Nigerian Union of Journalists Press Freedom Awards held in Abuja.

Danbatta, who was represented by the Director of Public Relations, Mr. Reuben Muoka said the refusal of some state governors to honour the MoU has continued to hamper the roll out of broadband infrastructure across the country by the telecommunication service providers.

He accused the state governments of breaking the Right-of-Way covenant signed between the National Economic Council, NEC and the Nigeria Governors’ Forum.

The agreement spells out modalities and fees to be paid by telecommunications operators intent on laying cables through the highways, state and local roads. It also states the responsibilities of each tier of government to ensure the smooth operation of telecommunications and other ICT operators.

The Federal Ministry of Communications Technology under the former minister, Mrs. Omobola Johnson, facilitated the deal following several complaints from telecoms operators about unfriendly treatments they were receiving from different state governments and host communities across the country.

The NCC boss said it was regrettable that instead of sticking with the agreement that aimed at deepening broadband penetration across the country, many state governments chose not to honour it.

He further attributed several poor quality of service issues rising in the sector to the failure of the state governments to abide by the agreement.

“The challenge remains with the refusal of the state Governors to abide by the agreement, but the NCC will continue to dialogue with government at all levels, and even communities.

“The MoU that was signed between the National Economic Council and the state Governors needs to be updated and reviewed.

“We understand that a lot of state governments are still not binding to the provisions of that understanding. But through the consultation of the NCC, the present leadership believes in consultation and dialogue.”

According to him, the Commission has been visiting state governments, organizations at various levels in order to let them understand resolve those issue because they remain critical, saying that, “We believe that without Right of Way implemented, we will not get there. If we are capable of doing that, the multiplier effects will impact on what we are hoping to get,” he stated.

On the award, the EVC said the Commission had done a lot to deserve the awards and pledged to sustain the existing relationship with the media for greater service delivery.

“We have received awards internationally and locally. The reason is that we are very open. NCC is about transparency, our transparency rings a bell, our way of collaboration and dialoguing with various segments of the industry is open as anybody can get information as possible.

“I believe that it is the media that projects our achievements, making the public understand the importance of telecom industry.

“Our website has been recognised as one that is very rich in information, very educative and always being updated,” said Danbatta.

NCC Still Want MTN, Glo, Airtel, 9Mobile to Start Data Roll Over

Data rollover simply means that whenever you subscribe for data and couldn't exhaust it within the validity period, it will still remain intact for you to use until it's exhausted.

We all know that when you purchase a data bundle and do not exhaust your allocated data within the given validity period, you lose whatever data you have left if you do not renew before expiration of the data plan.

Now it seems that Nigerian Communications Commission NCC want to come to our rescue. In fact, few months ago, they hinted about their plan to mandate Nigerian Telcos to implement data rollover.

This latest report is coming from Vanguard newspaper and it states that NCC has once again asked telecom operators to roll over unused data for their subscribers.

According to the news report, NCC’s Executive Vice Chairman, Prof. Umar Danbatta said:

“On this issue of data roll over, the Commission will soon issue a directive to the service providers to give 14 days window to the subscribers to enable them roll over their unused data, even if they do not renew on the expiration of data.
“In other words, this will stop the current practice where subscribers lose their entire unused data if they fail to renew on the data of the expiration of the current subscription.”

I don't know for you but I am particularly impressed with this development even though most times, I usually exhaust my data before the expiration date. It might not be same experience for those that are unable to use up their data bundles because of hectic days or other reasons. This category of subscribers constantly feel cheated of the subscription fees they paid.

TIME FOR THIS TO BE IMPLEMENTED?
No time has been officially announced yet by NCC but the way it's going, it won't take long before it's implemented.

Press Release: NCC Plans New Spectrum Auctions

The Nigerian Communications Commission (NCC) says it will soon auction and assignment new spectrums to boost broadband penetration in the country.

The Executive Vice Chairman of NCC, Prof. Umar Danbatta made this known in Lagos during the Telecom Executives and Regulator Forum, organised by the Association of Telecommunications Companies of Nigeria (ATCON).

The theme of the forum is: ”Removing Barriers To Growth And Innovation”.

Represented by the Deputy Director, NCC Technical Standards and Network Integrity, Mr Bako Wakili, Danbatta said that spectrum was a critical mobile infrastructure.

He said that the commission would strive to provide the required frequency spectrum capacity needed for broadband deployment.

According to him, the process for new spectrum auctions and assignments to drive mobile and wireless broadband is ongoing.

”The commission will facilitate the re-farming of existing spectrum held by operators to provide broadband services without impacting their Quality of Service (QoS) delivery.

”We will auction the 2.5/2.6 Gigahertz (GHz) spectrum for Fourth Generation (4G) Long Term Evolution (LTE) capacity requirements.

”The commission will also auction the 700 Megahertz (MHz) band once available, for 4G LTE coverage requirements and will open up and assign other spectrum bands in an open and transparent manner,” he said.

Danbatta said that according to the Nigerian Broadband Plan, Broadband within the Nigerian context was defined as an internet experience where the user could access the most demanding content in real time, at a minimum speed of 1.5 megabit per second.

According to him, broadband also means high-capacity networks that can deliver very large amounts of information simultaneously, as a result, they can deliver voice, data and video all at the same time.

”The broadband industry ecosystem comprises of government policies and programmes, regulatory frameworks and environment, then the supply and demand sides of the services.

”The industry is currently seeing the trend of increasing use of data enabled devices such as smartphones, dongles, MiFis, among others.

”With pervasive voice services objective largely achieved, the operators now focus on growth of data services and provision of optimal QoS delivery,” he said.

Danbatta said that the current status of broadband infrastructure in Nigeria showed that there was adequate international bandwidth from International submarine cable landing on the country’s shores.

He said that optimal deployment of broadband infrastructures was critical to driving broadband availability, accessibility and affordability in Nigeria.

According to him, the availability of broadband infrastructure will unlock new opportunities and drive a second wave of growth in the telecommunications industry and the economy.

He said that broadband was a productivity enabling technology and its penetration rate was 21 per cent as at February 2017.

Danbatta said the commission was optimistic towards achieving the 30 per cent broadband penetration target by 2018. (NAN)

NCC Mandates All Networks To Give 14 Days Data Grace to Subscribers

Now, here is a good news to all Nigerians. The Nigerian Communications Commission (NCC) has mandated all telecom operators in the country to give extra 14 days grace period once someone's data subscription expires without using all the data.

For instance, if you subscribed for one month data plan and you couldn't uses up the data before the 30 days or 31 days period, you will get extra 14 days grace period to use up the data. This is what NCC meant. The top networks providers in Nigeria like MTN, 9Mobile, Airtel and Glo are all affected.

According to a yesterday's report from ThisDay quotes a representative of the Executive Vice Chairman NCC, Professor Umar Danbata, at the Consumers Conversation Forum held in Minna, Niger State thus:

NCC has mandated all network providers to give their subscribers 14 days of grace after the 30 days expiration of their data if they still have data left and cannot recharge to get their data rolled over,


WHAT I KNOW SO FAR ABOUT THIS

This directives from NCC is not yet effective as of the time of this publication but I hope it's taken serious and implemented.

If it's implemented, am sure most of us will be very happy as some people rarely exhaust their monthly data bundle subscription and when there is no "data rollover" attached to the plan, you lost the data just like that.

Personally, whether it's implemented or not, I don't think it will affect me because even the Airtel 6GB for N1500 data plan is not enough for me in two weeks talk more of not using it up in 30 days.

THE Executive Vice Chairman of the Nigerian Communications Commission, NCC, Prof. Umar Danbatta is miffed that subscribers are fleeced by the operators in terms of the quality of data services on offer, demanding that more value should be given for money spent on data.
He also expressed the commission’s disgust at the snail speed of internet services and also urged both the operators and the internet service providers to invest more on infrastructure to ensure improvement in what is currently available.

Danbatta who spoke in an interview with one of the nation’s television networks, promised that government would look for a way of assisting network providers to ensure adequate infrastructure that would aid robust internet and improve data services. He said, “Data is becoming a major issue and infrastructure for data is a major headache in Nigeria. To ensure that we enjoy what we pay for, there is need for more infrastructure deployment.

“The statistics we have supports the claim that voice subscription has dropped to 148m (10%). But the data subscription is going up. One will expect the telecom companies to make more money from mobile voice services and SMS. But consumers are very clever, migrating from high tariff and poor voice services and SMS to data services.

“Unfortunately, the data services enable subscribers enjoy voice services like Whatsapp and so on. We are in a situation where we need value for money. There is an argument that with the infrastructure, the telcos will invest more here but what is happening in the social media space indicate that we need more infrastructure to optimize data services. We are concerned that until something is done by providing more infrastructure capacity, the data services will encounter more problems.”

On quality of internet service, he reportedly said the current poor quality of internet services was unacceptable and lamented the challenges the telcos are contending with. “I am not satisfied with the speed of internet experienced today.

The speed in the national broadband says 1.5 mega Hz per second. In places like Lagos, you may get higher speed, Kano you hardly get 500 kbits, which is too small. The disadvantage of having very slow speed of internet is that you can’t do so many things. Like I said, although we are contending with a lot of network challenges, the network operators should give value for money,” he added.

Nigerians Love 9Mobile - NCC Reports Revealed Increased Porting

The NCC’s “Incoming and Outgoing Porting Activities of Mobile Network Operators Report” for the month of May 2017, showed that 9mobile led the other four telecom operators in the Mobile Number Portability activities for the month in review

The Nigerian Communications Commission’s monthly porting report released through the regulator’s website on Thursday revealed that subscribers from other networks migrated to the rebranded 9mobile, Nigeria’s fourth largest telecommunication company.

The NCC’s “Incoming and Outgoing Porting Activities of Mobile Network Operators Report” for the month of May 2017, showed that 9mobile led the other four telecom operators in the Mobile Number Portability activities for the month in review.

NCC revealed that out of the total 39,535 porting activities in May, 19,816 were “Incoming Porting Activities”, while 19,719 were “Outgoing Porting Activities”.

9mobile recorded the highest incoming porting activity (users leaving other networks to 9mobile) with a massive 15,253 telecom users leaving MTN, Globacom and Airtel for the rebranded telecom company.

Airtel had the second highest incoming porting activity with 2,597 subscriber migrations.

MTN was third on the incoming porting migration table, with 1,245 telecom users, while Globacom had the least incoming migration figures on the table.

The report further showed that 9mobile also excelled on the outgoing porting migration table (users leaving 9mobile to other networks) with only 1,826 subscribers of 9mobile leaving to other networks.

This means 9mobile recorded the lowest outgoing porting when compared with the other operators.

Globacom recorded the second lowest outgoing migration with 4,786 subscribers.

Airtel recorded 6,540 outgoing migrations, while MTN’s outgoing subscriber migration was 6,567, making the network topping the table with the highest telecom users leaving the network.

Ransomware Virus: NCC Warns People About The Dangerous WannaCry Attack

The Nigerian Communications Commission (NCC) in fulfilment of its statutory mandate to assure the security and integrity of the national telecommunications network wishes to alert all operators and their respective subscribers of the recent outbreak of a Ransomware Virus known as “WannaCry”.

The Ransomware is capable of infecting and encrypting all files on a system or any smart device until an amount is paid for a decryption key, or other means of retrieval (which may lead to data loss) are used to recover the system as an alternative. This situation demands that proactive measures be taken by all players in the telecommunication eco-system to forestall the hazards of critical data loss, financial losses and ultimately network/business disruption.

The NCC therefore wishes to advise that the following protective measures be taken, amongst others:

✔ To obtain software patch released by Microsoft in March 2017 to fix the Ransomware Virus.

✔️ To plan scheduled penetration tests on the networks and systems to ensure protection and availability at all times.

✔ Subscribers who use their smartphones as substitutes to computers for internet access should protect themselves and their devices by:

✔️ Not opening e-mail attachments/links from unknown sources.

✔ Not clicking pop-ups and applets on unknown websites.

✔ Installing effective antivirus software for their mobile devices.

Furthermore, the NCC has taken the following proactive measures in fulfilling its statutory mandate;

The Commission has advised Mobile Network Operators (MNOs) to initiate regular assessment and audit of their cybersecurity readiness. All operators should continue to ensure that their backup/ disaster recovery strategies are in place and up to date.

✔ The Commission has further advised all operators to ensure continued deployment of effective firewalls, login passwords and antivirus management regime.

✔ The Commission is working towards creating a link with the Cybersecurity Alert System on its website so that current information on global cyber threats/incidents could be immediately communicated to stakeholders.

NCC Warns Nigerians To Beware Of Fraudsters Doing This

The Nigerian Communications Commission (NCC) has cautioned members of the public against letters of contracts purportedly awarded by the commission in circulation, saying they are fake.

The commission said in a statement on Saturday in Lagos, that its attention had been drawn to the circulation of letters of award of various contracts purportedly written by its Secretary.

“The commission wishes to categorically state that these letters were not issued by the commission.

“When contracts are to be awarded by the commission, adverts are published in various newspapers, the Federal Tenders Journal and our websites.

“The procurement process adopted by the Commission is always transparent and can be duly verified.

“The general public and corporate organisations are advised not to transact business with the unscrupulous persons issuing these fake letters,’’ it said.

The telecommunications regulator urge members of the public to ensure that thorough diligence was conducted in all cases to avoid falling victim to the peddlers of the fake letters of award.

It said that offers of the fake letters of award should be reported to the commission or the law enforcement agencies.

“Any person who deals with such peddlers of fake letters does so at his/her own risk,” the commission said.

Good News: NCC Suspends Increase of Data Price

The Nigerian Communications Commission on Wednesday announced the immediate suspension of the new minimum pricing template for data services by mobile operators.

The new rate, which would have led to price increase in data for some Nigerians, was scheduled to take effect from December 1.

The NCC said the decision is to allow for further consultation.

The NCC’s decision comes a few hours after the Senate ordered a stop to the planned increase.

NCC suspends directive on data segment price floor. Following the concerns that visited the directive to introduce price floor for data segment of the telecommunications sector beginning from December 1, 2016, the Nigerian Communications Commission (NCC) has suspended any further action in that direction.

The decision to suspend this directive was taken after due consultation with industry stakeholders and the general complaints by Consumers across the country.
The Commission has weighed all of this and consequently asked all operators to maintain the status quo until the conclusion of study to determine retail prices for broadband and data services in Nigeria.

Recall that the Commission wrote to the Mobile Network Operators (MNOs) on November 1, 2016 on the determination of an interim price floor for data services after the stakeholder’s consultative meeting of October 19, 2016.

The decision to have a price floor was primarily to promote a level playing field for all operators in the industry, encourage small operators and new entrants.
The price floor in 2014 was N3.11k/MB but was removed in 2015. The price floor that was supposed to flag off on December 1, 2016 was N0.90k/MB.

In taking that decision, the smaller operators were exempted from the new price regime, by virtue of their small market share. The decision on the price floor was taken in order to protect the consumers who are at the receiving end and save the smaller operators from predatory services that are likely to suffocate them and push them into extinction.

The price floor is not an increase in price but a regulatory safeguard put in place by the telecommunications regulator to check anti-competitive practices by dominant operators.

This statement clarifies the insinuation in some quarters that the regulator has fixed prices for data services. This is not true because the NCC does not fix prices but provides regulatory guidelines to protect the consumers, deepen investments and safeguard the industry from imminent collapse.

Before the new suspended price floor of N0.90k/MB, the industry average for dominant operators including MTN Nigeria Communications Limited, EMTS Limited (Etisalat) and Airtel Nigeria Limited was N0.53k/MB.
Etisalat offered (N0.94k/MB), Airtel (N0.52k/MB), MTN (N0.45k/MB) and Globacom (N0.21k/MB).

The smaller operators/ new entrants charge the following: Smile Communications N0.84k/MB, Spectranet N0.58k/MB and NATCOMS (NTEL) N0.72k/MB.
The NCC as a responsive agency of government takes into consideration the feelings of the consumers and so decided to suspend the new price floor.

Following the Nigerian Communication Commission directive for all networks in Nigeria to increase the price of data plans (rumored 300% increase) starting from tomorrow December 1st 2016, I think it's wise for anyone that can't do without data plan on his or her smartphone or PC to subscribe for data today.

This is because, from tomorrow prices of data might skyrocket in the sense that you could be subscribing for just 1.5gb with N3000. Isn't it outrageous? Before this wicked directive from NCC, we use to get 3GB for just 1500k on Airtel network and 1.5GB for 1k on MTN and Etisalat networks while Glo offers the cheapest data plans but it's all going to be messed up from tomorrow.

Telecom operators in the country has started issuing warning messages to their customers about the Imminent data price increment from tomorrow as you can see from the screenshots on this post.

Prices Of All Data Plans Will Be Increased Starting From Dec 1st - NCC

What is really happening in Nigeria? Why is it that the average citizens are presented with one of the worst hardship conditions? It is not getting funny any longer as the common man in the street doesn't have any hope again. No quality education, no work/employment, no better infrastructural development, recession, strict laws etc.

Imagine when everyone rejoiced that the telecom industry in Nigeria has finally heard the complaints of people by reducing price of data plans and call rates this year, the Nigerian Communication Commission (NCC) just mandated all Telcos in the country including MTN, Etisalat, Airtel and Glo to increase price of data plans effective from December 1st 2016

This is absolutely not acceptable by me especially in this period when so many people including students are finding life so difficult because of the economic situation in the country. How can students from poor family survive? How can they be subscribing for data to carry out researches and assignments? Our government doesn't think in that part. They just think in one direction.

This is sad, NCC believes that this is one of the ways they can generate revenues for the Government. They know that we can’t do without buying data… so they decided to mandate all Telcos to increase their data price… hmm!

Recently, CBN governor Godwin Emefieli proposed taxes on phone calls that exceeds 3 minutes. My question is; what have they done with other taxes and privatization they did before? We wake up everyday with one bad economic news or the other.

With this, we might be getting just 500MB with N1000 instead of the 1.5gb we normally get. So sad.

The Nigerian Communication Commission (NCC has fined Chinese Smartphone makers InnJoo a sum of 4 Million Naira for selling unauthorized mobile phones in Nigeria.

This action was however taking after many Nigerians that bought some of the smartphones from the company complained of so certain issues like poor network reception and swelling of battery which was a bit rampant with the Innjoo Halo Smartphone. Another case was the confusion in the processor used in making some of the devices claimed to be MTK processors which wasn't in reality.

NCC raided the office of InnJoo mobile phone maker in Lagos earlier this week for selling 'substandard' mobile phones to the public and sealed their office

It is worthy to know that Innjoo was in the verge of competing and defeating the likes of Tecno, Infinix and Gionee in 2014 and early 2015 when they won the heart of so many Smartphone lovers in the country with their Smartphones BUT something happened along the line, they declined totally in the pecking order. The reason is best known to them but one of the main reason should be the unavailability of their phone spares, poor customer service and the recent substandard nature of their phone components.

Is N4Million too small or big for them? I think it's small and that's why they quickly paid it within short period of time unlike MTN that were fined Billions of Naira.

Birth and early career

Durojaiye earned a BSc (Economics) London, and an LLB, London. He was called to the Nigerian Bar in 1979, and is a Barrise Supreme Court of Nigeria. He also graduated from the National Institute for Policy and Strategic Studies, Kuru. He worked for 35 years in the Nigerian public sector, including 28 years as a Director of the Central Bank of Nigeria and the National Mint. He worked with the International Monetary Fund, the Federal Reserve System in the U.S.A and the City University London between 1964 and 1982.

Political career

Durojayi was an elected member of the 1988/89 Constituent Assembly. In 1992 he was a candidate to run for President of Nigeria on the platform of the Social Democratic Party (SDP), losing to M.K.O. Abiola. Abiola's subsequent election as president was quashed by General Ibrahim Babangida, leading to a return to military rule. In December 1996 Durojayi was arrested by the military regime of General Sani Abacha, and was imprisoned for 560 days and mistreated while in jail. A June 1997 report stated the 63-year-old lawyer was reportedly in poor health and suffering from high blood pressure caused by his treatment. Amnesty International designated him a prisoner of conscience and campaigned for his release.


Durojaiye was an elected Senator of the Federal Republic of Nigeria (1999-2003). After taking his seat in the Senate he was appointed to committees on Judiciary, Establishment (Chairman) and Special Projects. In December 2002 he recommended a life jail-term for anyone who perpetrated election fraud. He won the AD primaries to represent the party in the Ogun East constituency in the 2003 elections, although he was threatened with legal action by Chief Adamo Olayinka Yesufu, a rival for the nomination. In the event, the PDP candidate Tokunbo Ogunbanjo won the election

Durojaiye's wife Florence Olufunso Adejoke died on 6 June 2009, aged 72, in Ikeja, two months after she and her husband had marked their 50th wedding anniversary. She was survived by her husband, six children and many grandchildren. In a March 2010 interview Durojaiye, now in his late 70s, spoke out against the covert way in which President Umaru Yar'Adua's illness was being handled, with the President smuggled back into Nigeria at night and no reports issued on his condition

At Last, NCC To Fine MTN, Etisalat, Others N5m For Unsolicited SMS And Calls

Finally, Nigerian Communications Commission (NCC) has risen to fight for the masses cry on spam SMS and calls that Telcos usually bombard our mobile phones with.

From a report by Leadership, NCC made it clear that they would fine any network operator that sends unsolicited messages or calls to its subscribers a sum of N5 million. The regulatory body introduced a general unique number which is to be used to opt out of all the marketing text messages. NCC said they will sanction any telco that refuses to abide or implement the shortcode of 2442 for subscribers to opt-in to the “Do Not Disturb” (DND) database which stops spam marketing messages on or before the 30th of June. According to the report.

"NCC in a letter dated April 19, 2016 warned MTN, Airtel, Globacom, Etisalat, Smile, Natcoms (Ntel), Visafone, Starcomms, Multilinks, Gamjitel, Danjay Telecoms, Gicell Wireless Ltd and Megatech Engineering Ltd that they should implement the DND restricting telemarketing their MSISDNs including the use of web-based solutions as opt-out measures.
The regulator said it shall be mandatory for mobile operators to create sufficient awareness to its subscribers on the existence of the DND on their networks; that they shall also comply with the quarterly and reporting template prescribed by the NCC to ensure feedback and compliance".

Meanwhile, NCC has not totally scrapped unsolicited messages as they have issued that generated text messages must comply with the 8am to 8pm stipulation (12 hour period), but the interesting aspect of this whole drama is that subscribers now have the option to easily opt-out of any messages they don’t want which is cool if you ask me.
